Driver Involved In Fatal Daycare Van Crash Indicted For Murder

A second-degree murder charge has been added against a 38 year-old man the Highway Patrol says caused a fatal crash last year.

On November 6th, troopers said Seth Charles Tracy of Holly Springs was operating a plumbing truck on Barber Mill Road south of Clayton when he crossed the centerline and slammed head-on into a Kids Country of Clayton daycare van. The driver of the van, 39 year-old Martha Darlene Peterson of Kenly died at the scene. Five children in the van were taken to Wake Medical Center with non-life threatening injuries.

Tracy was initially charged with death by motor vehicle and driving while impaired.

A Johnston County Grand Jury met this week and handed down a True Bill of Indictment charging Tracy with second-degree murder for Peterson’s death.  Tracy was served with the indictment on Thursday.

Tracy has been held in the Johnston County Jail under a $1 million bond since the crash.
