The man charged in the death of a 10-year-old girl is back in jail after he failed to appear at a court hearing on his case.

Dunn police arrested Ronald Fox, 67, of East Granville Street, around 3:19 p.m. Wednesday. Fox was originally scheduled for a Nov. 16 court date, but didn’t show up according to court records.

Fox is charged in the April 12 death of Danay Allen after police say he hit the girl with his car. Danay was struck near the intersection of Spring Branch and Jackson roads when she and her family were out chasing their puppy that night.

Fox was charged with felony death by motor vehicle, driving while intoxicated and reckless driving.

The Wayne Avenue Elementary fourth-grader was returning to her family’s car when Fox ran off of Jackson Road, barreled up the grass, jumped a curb and struck Danay, according to a witness.

Bystanders rushed to the aid of the girl and carefully freed her from the car she was pinned under.

Danay was transported by EMS personnel to Betsy Johnson Hospital before being airlifted to Chapel Hill Hospital where she was pronounced dead.
