A federal grand jury in Wilmington has indicted a 37 year-old man arrested in Smithfield in September on a federal charge of Illegal Reentry of a Deported Alien.
Rigoberto Trejo Ponco, 37, of Mexico had previously been deported for a felony conviction of possession of drugs. If convicted on the new indictment he could face a maximum of 10 years in federal prison, a $250,000 fine, and a term of supervised parole following any term of imprisonment.
Ponco, who has a Clayton area address, was involved in a traffic accident last month in Smithfield during which a small amount of suspected cocaine was found. He was also charged with driving while impaired.
The case is being investigated by ICE’s Enforcement Removal Operations.
