Driver Involved In Deadly Daycare Van Crash Makes First Appearance In Court

A 38 year-old man charged with death by motor vehicle and driving while impaired following a deadly wreck near Clayton made his first appearance in Johnston County Court today (Wednesday).

Wearing an orange and white stripped prison uniform, Seth Charles Tracy of Holly Springs appeared in court just before Noon.

A judge ordered Tracy remain in the Johnston County Jail.  The judge did not lower his bond what had been set Tuesday night at $1 million.

The Highway Patrol says Tracy was operating a plumbing van around 4:00pm Tuesday when he veered across the centerline on Barber Mill Road slamming into a Kids Country of Clayton daycare van being driven by 39 year-old Martha Darlene Peterson of Kenly.   Peterson died at the scene.

Five children in the van were taken to Wake Medical Center for treatment of non-life threatening injuries.  Photos by John Payne
