Trooper: Judge Admits To Drinking ‘Earlier In The Day’ Prior To DWI Crash

HARNETT COUNTY – A rear-end collision between two vehicles in Harnett County on Monday afternoon led to the arrest of a judicial official for driving while impaired, child abuse and other charges.

District Court Judge Jason Phillip Kimble of the 11th Judicial District of North Carolina (covering Harnett, Johnston and Lee counties) was involved in a crash at 3:07 p.m. Monday on Turlington Road.

Trooper G.C. Middlebrooks of the N.C. State Highway Patrol’s Troop B, District 8, investigated the crash.

In a sworn affidavit and revocation report, Middlebrooks noted that Kimble, 44, of 95 Brandon Drive, Lillington, had an odor of alcohol on his breath and “red glassy eyes.”

Kimble “stated he drank” an alcoholic beverage “earlier in the day,” according to Middlebrooks’ report. The trooper said he “had reasonable grounds to believe …” the defendant was involved in a rear end collision because he was slow to stop. The trooper’s sworn statement says that the defendant provided a positive portable breath test. Based upon Kimble’s performance of a walk and turn, one leg stand and horizontal gaze nystagmus, (all standard field sobriety tests), the trooper determined Kimble was too impaired to safely operate a motor vehicle.

Kimble was driving a 2010 GMC SUV. There were no injuries reported in the crash.

Kimble was charged with driving while impaired and Middlebrooks requested a sample of his breath, blood or urine to do a chemical analysis. Kimble refused.

Harnett County Magistrate Rhonda G. Holder found probable cause that Kimble willfully refused to submit to a chemical analysis on Sept. 25. She ordered his drivers license be revoked for at least 30 days, according to on line court records. Kimble surrendered his drivers license to the court.

As a result of the wreck, Middlebrooks also charged Kimble with reckless driving, child abuse and failing to reduce speed.

Reports state that Kimble had a child under the age of 18 in the vehicle with him at the time of the crash.

  2. This is a shame not to mention a bad reflection on the counties he serves. Hats off to SHP Middlebrooks for a job well done. This “judge” needs to be held accountable for his wrong doings. He could of injured or killed the child that was in the vehicle with him. He needs to be removed from his duties as a judge.

To “tell the truth”….I do agree with many of your comments, however, my family has been in Johnston County for over 200 years and calling “a person who lives in the country, regarded as being unintelligent or provincial” is uncalled for. I have meet numerous actual hicks from up north that have been implanted around here and if you don’t like Johnston County, take your yankee arse back to New York.
