Man Steals From Walmart By Faking Dog Food Return, Report Says

GARNER – A 32 year-old man was arrested after he reportedly tried to return a bag of dog food for a refund at Walmart, even though he never paid for it. Johnston County deputies arrested Nicholas Ryan Burgess of Rosie Lane, Dunn on January 26th around 1:30pm after responding to Walmart at 5141 NC Highway 42 West, Garner in the Cleveland community.

Deputies allege Burgess entered the store and removed a bag of dog food, valued at $29.66, from the shelf. He took the dog food to the customer service desk and asked for a refund. He also produced a prior receipt for an identical dog food purchase at a Wayne County Walmart.

Burgess was charged with a felony count of obtaining property by false pretense. He was held under a $10,000 secured bond.

    • Did you read the article? The guy is from Dunn. Dunn is in Harnett County. Just because something happened somewhere does not mean that the indiviual(s) is from that area.

  2. Charged with a felony ? Maybe I misread the information in this article. The way I read it was that he removed a bag of dog food valued at $29 from the show and tried to return it. So did he accomplish the return? Did he actually obtain the property by false pretense? my understanding is that he “attempted ” to obtain property by false pretense. And does property valued at $29 constitute a felony now?
    I imagine his attorney is going to have fun with this one .

  3. I believe Mr. Shug is very well educated in N.C. Law. False Pretenses and Cheats. § 14-100. Obtaining property by false pretenses. If the value of the money, goods, property, services, chose in action, or other thing of value is one hundred thousand dollars ($100,000) or more, a violation of this section is a Class C felony.

If the value of the money, goods, property, services, chose in action, or other thing of value is one hundred thousand dollars ($100,000) or more, a violation of this section is a Class C felony.
