Candidate Challenge Hearing Postponed

SMITHFIELD – The Johnston County Board of Elections postponed a hearing on a candidate residency challenge until next week. The election board convened at 9:00am Wednesday (today) for the hearing after school board member Ronald Johnson challenged the residency of David Marshburn.

Johnson is seeking reelection to a newly created District 7 school board seat. Marshburn filed for the seat challenging the incumbent.

Johnson contends Marshburn does not actually live in District 7, but resides in District 5.

At the beginning of the hearing, election board chairman Gordon Woodruff recused himself due to a potential conflict of interest. Mr. Woodruff is an attorney and one of his clients is the Johnston County school board.

The election board voted to appoint John Shallcross to chair the hearing.

Smithfield Attorney Jack O’Hale said he had been retained by Mr. Marshburn on Tuesday and needed additional time for research and to prepare for the hearing.

Johnson said he was concerned the postponement was a stall tactic to allow Marshburn additional time to establish a residence in District 7. Johnson stated Marshburn was not entitled to a continuance.

The board agreed to postpone the hearing until Wednesday, January 10th at 9:00am.

  1. All it takes is a little google to see there is no house at 708 S Robertson St. Clayton, So how can he live there?

    • Zillow, Realtor and virtually every real estate site disagree with you. Also, it was sold in Aug 2020, as JoCo tax records show.

      • Going by street views there is a 710 House (with numbers on the house) and a 610 house (with numbers on the house). 708 has a mailbox but nothing there

        • It’s clear to me that you do not understand how to use MapClick on the county GIS site. Not my job to explain it to you.

          • Sorry. That was snarky. I apologize.
            Point being that you can’t rely on Google street views to determine real estate parcels. The GIS is much better for actually locating property and all of the associated information.

        • My “reference” is the county website as it pertains to real estate parcels and I am not in charge of checking it. Yes, I am persistent, thank you. Do you really think people are hiring lawyers and holding meetings over an empty lot?? My goodness. Really. Speaking of acting like a 15 year old.

        • Brett, take a look at Google Street View again. Move down the road a little bit closer to highway 70, then turn and look at the house situated at 610 S. Robertson Street. You’re able to clearly see the house that is at 708 S. Robertson Street at that point. It’s a weird placement, but the house is most definitely there.

          • You’re no fun. I generally like for people to figure things out on their own. But that was becoming increasingly difficult, I guess.

    • The house at 708 S. Robertson Street is physically situated behind the house at 610 S. Robertson Street. I don’t know why this is the case, but this is very easy to verify with Google Maps (both satellite views and street views) and MapClick, which is what Johnston County uses as their GIS site. There is absolutely a house at that location.

      • Yep. I know why that is the case, but I am tired of explaining JoCo real estate on this site. And be careful using terms like “very easy”. Brett will call you a 15 year old.

  2. Marshburn is so full of it. Everyone who knows him knows he lives with his wife and son at their permanent residence not some rented property. He continues to be shady and thinks people are stupid. Some see right through him and God knows the truth! Johnston County would be better off without him in it….go rent and live somewhere else!

  7. What exactly is the address he is claiming to live in? Should be pretty easy to find out if he is in fact a resident there. The fact that attorneys are involved should let everyone know the guy does not reside there. Thanks to those who brought it to the board of elections attention.

People see you for what you are. You only have some fooled, trust and believe. You are not genuine in your efforts to serve JOCO. You have an agenda and it’s not for the betterment of JOCO citizens!

  9. David Marshburn is a total scammer. His come find me foundation was all about grabbing non profit money and he didn’t even file his IRS paperwork properly. I knew him at a very young adult. He was trying to be a contractor and was taking large amounts of money from a close friend of mine and doing work comparable to a full blown hacker. In the end he took the money and ran leaving an unfinished mess. Saw it first hand. Redid a lot of it myself. His mother was an abusing 7th grade teacher that everyone was afraid of as a 7 th grader. Her and James Elmore prided themselves at the mean teachers on the hall at Cooper middle school.
