District Attorney: State Troopers Were Justified In Use Of Deadly Force

Suspect Arrested And Held Under $1 Million Bond

KENLY – Johnston County District Attorney Susan Doyle has ruled three troopers with the NC Highway Patrol were justified in the use of deadly force against a Kenly man during an incident earlier this year.

Joshua Taylor Haynes was shot during a standoff with law enforcement officers while at a home in the 500 block of South Wilson Street in the Kenly city limits. Haynes was rushed to WakeMed with critical injuries. He recovered from his gunshot wounds.

The incident started around 12:54am on June 11, 2023. Kenly Police responded to a shots fired call and arrived to find a man, identified as Haynes, allegedly barricaded at a residence. Sheriff’s deputies and state troopers responded to assist Kenly Police. After arriving, the three troopers reportedly encountered the 34 year-old man when he emerged from the residence, producing a firearm. The troopers ordered Haynes to drop the gun, but he allegedly ignored repeated commands. Troopers fired at Haynes, striking him several times.

Troopers J.F. Deal, L.S. Frederick, and C.M. Wilson were placed on administrative leave pending the outcome of an investigation by the NC SBI.

In an October 5, 2023 letter, District Attorney Doyle stated, “Officers must often make split-second decisions regarding their use of force. Under the circumstances observed by Troopers Deal, Frederick, and Wilson, and corroborated by more than a dozen other witnesses there on the scene, their use of force was both reasonable and warranted… As a result, no criminal charges against the three troopers will be filed related to this incident.”

“However, I am authorizing Kenly Police Department to file charges against Joshua Taylor Haynes because of this incident. Although I typically issue very detailed factual findings in officer-involved shooting cases, I will refrain from doing so at this time based upon the Rules of Professional Conduct 3.6 and 3.8. Based upon my interpretation of those rules, it would be unethical for me to divulge these facts as they will directly relate to the pending charges against Haynes,” District Attorney Doyle stated in the letter.

Today (Thursday), Joshua Haynes was arrested by Kenly Police on multiple charges. They include three counts of felony assault with a deadly weapon on a government officials, three counts of felony habitual misdemeanor assault, three counts of misdemeanor child abuse, one count of discharging a firearm within town limits/city ordinance, one count of resisting a public officer, five counts of communicating threats, and two counts of ethnic intimidation.

The child abuse charges reportedly stem from three children who were inside the residence at the time of the incident. The ethnic intimidation offenses accuse Haynes of allegedly using derogatory names, in a threatening manner, towards two African American law enforcement officers.

Haynes was booked into the Johnston County Detention Center where he is being held under a $1 million bond.

“The Kenly Police Department would like to emphasize the dedicated and challenging work of law enforcement officers, who put their lives on the line to protect our community,” Police Chief James Ayers said. ” We are relieved that no residents or officers were injured during these incidents.”

  1. Good . It is a shame his wife took him back after this incident. I don’t understand some women. Hopefully she cannot bail him out. If she does, someone from CPS needs to get involved and remove the children from the home. The children deserve better.

  2. Heartfelt thank you to all the Law Enforcement Officers at the incident. Thoughts and prayers toward LEO and families. Hopefully the adults in the children’s lives will help them get through this drama.

    I sure hope he is not allowed around the children.
    Next time, and there will be a next time, things may be drastically different for this family.

  4. Quite the record according to NC DPS Inmate Search. No incarcerations – yet. Looks like he, in the past liked to drink and fight. Something has triggered him to return to his very bad habits it seems. Dude, get help. Wife – leave, while you can…or make him leave….but do something. Seen this too many times. Doesn’t end well…usually.

    I do hope his condition of release, since he has been bonded out, precludes him from being around his children – any children. Supervised visits with someone other than his wife since she apparently excuses his behavior for some reason. Marriage Vows can be meaningful but they are not meant to give either person free rein to disrespect (or worse) their spouse and then always get total forgiveness. No one should ever be made to feel like they must stay married or else * they* have failed.
