Former Smithfield Employee Now Faces 11 Charges In Sex Crime Investigation

SMITHFIELD, N.C. – A former Town of Smithfield employee already facing six charges in an Erwin Police Department investigation is now facing five additional charges after another alleged victim came forward.

James Allen Tyndall Jr., 34, of Dunn, was initially charged with three counts of indecent liberties with a minor and three counts of sexual battery.

Court records show additional warrants were issued Sept. 8 charging Tyndall with three more counts of sexual battery and two additional counts of indecent liberties with a child. The latest charges were filed by Dunn Police.

The new charges bring the total number of charges against Tyndall to 11.

Allegations Date Back Several Years

According to the new arrest warrants, the three sexual battery charges stem from alleged incidents on or about Sept. 1, 2020.

The two additional indecent liberties charges stem from alleged offenses on or about April 1, 2022. The warrant states the alleged victim in those charges was under age 16 at the time.

The warrants were issued Sept. 8 by a Harnett County magistrate.

Investigation Began In August

Erwin Police Chief Jonathan Johnson previously said the investigation began Aug. 26 after officers received a complaint alleging inappropriate conduct involving a juvenile.

Detectives obtained the initial arrest warrants Sept. 2. Erwin Police, assisted by the Dunn Police Department, also executed a search warrant at Tyndall’s Dunn residence.

Tyndall remains in the Harnett County Detention Center. He was previously held under no bail. His bond was set at $750,000 secured this week.

Former Smithfield Employee, Softball Coach

The Town of Smithfield previously confirmed Tyndall was hired May 16, 2022, and most recently worked as a meter technician. He is no longer employed by the town.

Tyndall also coaches a girls’ travel softball team and has provided private baseball and softball instruction to children.
