Overturned Smart Car Leads To DWI

SMITHFIELD – A Four Oaks man is facing charges after Smithfield Police located a Smart car overturned in a ditch.

Around 8:32pm Thursday, officers were dispatched to a single vehicle accident on S. Brightleaf Boulevard near Kay Drive. According to an accident report, Marbin Joan Turcio-Amaya, age 26, of George Street, Four Oaks was traveling northbound when he ran off the roadway to the right and overturned in a ditch. The car traveled 152 feet before coming to rest on its roof in the ditch.

Turcio-Amaya reportedly told officers he was distracted by texting and driving. He declined medical treatment.

Turcio-Amaya was charged with driving while impaired and driving while his license were revoked for an impaired revocation. He registered 0.21 on the Breathalyzer, more than double the legal limit of 0.08.

The 2011 Smart was seized by police. The car sustained approximately $4,000 in damage, according to the accident report.

  1. Repeatedly drunk driving after your license has been revoked should justify prison time.

  2. Nobody is perfect. I know this person personally. If you don’t know what someone is going through then don’t judge. Nobody is perfect and everyone makes mistakes. No matter what the mistake is. Only a perfect person should be judging someone’s mistakes.

    • NC Resident, I do tend to agree with your points about judgement, but driving while drunk when your license had already been revoked for impaired driving is a pretty terrible thing to do. It’s a matter of safety. This person could have very easily caused major harm to someone if he had hit them, even in a very small vehicle like a Smart car. We have laws for operating motor vehicles for a reason, and this person has repeatedly broken those laws. It’s a good thing he didn’t hurt anyone (including himself), but the fact that he was driving at all says a lot about his willingness to follow the law and his care for the safety of others.

    • To NC Resident, you cannot be serious with your comment. Mistake??? Look dear, since you call these direct disregards for other’s lives “mistakes”….then mistake #1 was even getting in the car, #2 driving with revoked license from a prior driving while impaired, #3 driving while impaired, #3 texting while driving, #4 making a conscious effort of distracting himself, and #5 not mentioned here but I can probably bet the smart car wasn’t insured. Those are NOT mistakes. Those are deliberate. Oh, but wait, you know him personally….then if what you’re saying is he needs help then HELP him but keep him off the streets so he doesn’t kill someone else or himself.

  3. Slap him on the wrist and let him go. That’s what the state does anyway. That’s why we keep having drunk drivers on the road. Everything is about money and how much the state can make from drunk drivers. Put them in jail for at least 2 years to start and cut out this crime.
